Why The Affordable Health Care act, aka Obama Care, is un Constitutional and should be abandoned.

First of all, let me state for the record, I am a Veteran that studies the Constitution for the united States of America, and believe and support it.

Second, I agree that our health care system needed some massive restructuring, but the answer was not this so called "Affordable healthcare act", aka Obama care.

Third, health care is not a right. It can never be a right. Since it is dependent upon a second party, it cannot even come close to being in the ball park of being considered to be a right.  You can give yourself health care, which is what you do every time you make a choice. But if someone else has to give it to you, it is no longer a right but a privilege.

Rights come from our creator, not government. God cannot give you healthcare. He can give you free speech.


Under this nation's Constitution, the Federal government has limited powers and has specific jobs to do. Common defense of the Nation is the first item. There are others listed in Article 1 of the Constitution for the united States of America.

Yet it is not doing that. Our borders are wide open and we are being invaded for economic gain, which is no different that having a war with guns that achieve economic gain.

The job of the federal government is to govern the 50 governments that make up the 50 states of the union. At one time in our history the term "State" was equal to and meant the same as "country". Therefore the Federal government is the government of governments. It was NEVER intended to apply to individual people as they are not signers of the contract which is the Constitution.

The Bill of rights does not grant rights. It is amendments that further restricts federal governments power and was designed to protect the rights of the people, hence its name. But it protects rights, not grants them.  People of the USA have several rights not even mentioned in the Constitution.

The right to choose, free of interference or any form of intimidation.
The right to consent or not to consent. To give your approval or not give your approval. Under this law you have no choice. You participate in it, or are fined.  That is not freedom.

These 2 fundamental rights have been violated by the Affordable health care act. And as such it cannot stand as a valid law.

The Federal congress cannot require us to participate in Social Security, therefore they also have no authority to require us to participate in "the affordable care" act.

No one in the USA has the right to reach into another's pocket and take what they want and do it lawfully, simply because there was a majority vote.  People have the inalienable right to keep the fruits of their own labors, unless directed otherwise by Judicial due process, or by Government authority which is the result of a law being passed that is in harmony with our Nations' and our States' Constitutions. And "the affordable healthcare act" is NOT Constitutional.

No one has the right to force another to provide services to him or her. Yet that is what this so called law does.

No one has the right to make the American people pay for the health and welfare of criminals that enter this country illegally, yet this is what this so called law, does.

No one has the lawful right to decide how much money my health care provider can make. To impose such a state upon them, would be to impose a state of involuntary servitude upon them, and to imply ownership of that person. Both are unlawful in this nation.

And one more reason. The 13th Amendment to the Constitution forbids a state of involuntary servitude from being imposed on a Citizen of the United States until judicial process has been granted.  No judicial process has been granted to me.

This law requires me to take my property (my resources) and use them in a manner I may not agree with, nor consent to, and if I do not do that, the law then penalizes me for not doing so. THAT is the state of involuntary servitude.  

As such it is totally unconstitutional.
